1. Introduction
1.1
These Terms and Conditions (“Terms”) govern your access to and use of Fate, including the Fate mobile application, website, related services, features and content (together, the “Service”).

1.2
In these Terms:
“Fate”, “we”, “us” or “our” means FATE DATING APP LTD;
“you” or “your” means the person accessing or using the Service;
“App” means the Fate mobile application;
“User Content” means any content submitted, uploaded, created, recorded, transmitted or displayed through the Service, including photographs, voice notes, profile information, messages and communications;
“Tokens” means digital in-app credits that may be made available through subscriptions, packages, promotions or other features.
1.3
By creating an account, accessing or using the Service, or purchasing a subscription or Tokens, you agree to these Terms.
If you do not agree to these Terms, you must not use the Service.
1.4
Our Privacy Policy and Cookie Policy contain important information about how we process personal data and use cookies and similar technologies. They should be read alongside these Terms.
2. Eligibility and Age Requirement
2.1
Fate is strictly intended for individuals aged 18 years or over.
You must not create an account or use the dating Service if you are under 18.
2.2
By registering for Fate, you confirm that:
You are at least 18 years old;
You are legally capable of entering into a binding agreement;
You have not previously been permanently removed or banned from Fate unless we have expressly permitted you to return;
The information you provide is truthful, current and complete; and
You will comply with these Terms and applicable law.
2.3
Fate currently operates a date-of-birth age gate during onboarding.
If the date of birth entered indicates that you are under 18, you will not be permitted to complete account creation.
We may introduce additional age-assurance or verification measures in the future where we consider this appropriate or where required by law, regulation, platform requirements or safety considerations.
2.4
Where we reasonably suspect that an account is being operated by a person under 18, or that false age information has been provided, we may investigate, restrict, suspend or remove the account.
2.5
If you believe that a person under 18 is using Fate, please report the account through the available reporting tools or contact support@fatedating.com.
3. Account Registration and Security
3.1
Available account-creation methods may include:
Email and password;
Email verification or one-time password;
Google Sign-In; and
Apple Sign-In.
3.2
You may create and operate only an account belonging to you.
You must not:
Create an account for another person;
Impersonate another person;
Provide materially false or misleading information;
Use another person's photographs, voice, identity or personal information without permission;
Sell, transfer, share or provide another person with access to your account;
Allow another person to operate your account;
Circumvent an account restriction, suspension or ban; or
Attempt to create replacement accounts following a permanent ban without our permission.
3.3
You are responsible for keeping your account credentials, verification codes, email account and device secure.
If you believe that somebody has gained unauthorised access to your Fate account, contact support@fatedating.com promptly.
4. The Fate Service
4.1
Fate is a dating and social-connection platform designed to help users discover and communicate with potential matches.
Our matching systems may consider information such as:
Profile information;
Personality and values;
Preferences;
Photographs;
Voice-based information;
Age and gender filters;
Interactions and activity;
Previous matching outcomes;
Feedback;
Behavioural information; and
Other information described in our Privacy Policy.
4.2
Features may include:
Profile creation;
Voice notes and voice-based features;
Curated or recommended matches;
Matching and compatibility systems;
User-to-user messaging;
Voice or other communication features;
Conversation prompts;
Feedback and insights;
AI-powered functionality;
Tokens and paid features;
Reporting and blocking;
Moderation and safety features; and
Analytics or personalised recommendations.
4.3
Features may differ depending on:
Your location;
Device;
Operating system;
Subscription;
Account status;
Product version;
Testing programme; or
Feature availability.
We do not guarantee that every feature will always be available.
4.4
Fate provides a platform through which users can meet and communicate.
Fate is not:
A dating agency providing individually guaranteed introductions;
A relationship counselling service;
A medical, psychological, legal or financial advisory service;
A criminal background-check service;
An emergency service; or
A guarantee that another user is genuine, compatible, safe or suitable.
You remain responsible for deciding whether, when and how you communicate with or meet another user.
5. Acceptable Use
5.1
You must use Fate lawfully, responsibly and respectfully.
5.2
You must not use Fate to:
Harass, threaten, intimidate, bully, stalk or abuse another person;
Continue contacting somebody who has asked you to stop;
Send hateful, discriminatory, degrading or abusive material;
Engage in sexual exploitation, trafficking, coercion or abuse;
Share, request, encourage or distribute sexual content involving a person under 18;
Share intimate or sexual images of another person without their consent;
Blackmail, extort or threaten another person;
Encourage violence, terrorism, self-harm or serious criminal behaviour;
Facilitate or promote illegal activity;
Defame another person unlawfully;
Distribute malware, viruses or harmful software;
Interfere with or attempt to compromise Fate's infrastructure or security;
Scrape, harvest, copy or systematically collect profiles, photographs, messages, voice recordings or other data;
Reverse engineer or attempt to discover the underlying source code, models or protected systems except where applicable law expressly permits it;
Operate bots, scripts, automated accounts or unauthorised third-party tools;
Manipulate the matching, moderation, verification, Tokens, rewards or feedback systems;
Use Fate primarily for advertising, recruitment, commercial solicitation, escort services or lead generation without our written permission;
Collect another user's personal information unlawfully;
Use Fate data or content to train, benchmark or develop a competing artificial-intelligence or dating product without permission;
Impersonate Fate, an employee of Fate or another user; or
Use the Service in a manner that creates an unreasonable safety, legal, security or regulatory risk.
5.3
We may investigate suspected violations and take proportionate action in accordance with these Terms, applicable law and our safety procedures.
6. Fraud, Scams and Financial Abuse
You must not use Fate to commit or facilitate fraud, scams or financial abuse.
This includes:
Romance scams;
Impersonation;
Using stolen identities, photographs or payment information;
Asking another user to provide passwords or verification codes;
Asking users for money, cryptocurrency, loans, investments, gift cards or financial assistance as part of fraudulent or exploitative conduct;
Directing users to fraudulent investments, websites or downloads;
Attempting to obtain banking or payment information deceptively;
Money laundering;
Misrepresenting your identity or intentions for financial gain; or
Operating an account principally to solicit or defraud users.
We may suspend or terminate accounts associated with suspected fraud and may preserve or disclose relevant information to regulators, law enforcement or other authorities where permitted or required by law.
7. User Content
7.1 Ownership
You retain ownership of User Content that you submit to Fate.
7.2 Licence to Fate
By submitting User Content, you grant Fate a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, format, process, display and otherwise use that content only as reasonably necessary to:
Operate and provide Fate;
Display and maintain your profile;
Provide matching and recommendation functionality;
Provide messaging, communication and voice features;
Provide AI-supported features;
Moderate content and maintain platform safety;
Investigate reports and enforce these Terms;
Improve and maintain the Service;
Comply with legal obligations; and
Generate anonymised or aggregated information where permitted by law.
This licence does not transfer ownership of your User Content to Fate.
7.3
The licence relating to identifiable User Content generally ends when that content or your account is deleted, except where:
Information has already been shared with another user;
Retention is required or permitted for legal, safety, fraud-prevention or security reasons;
Technical deletion requires a reasonable processing period; or
Information has been irreversibly anonymised or aggregated.
Personal-data processing is governed by our Privacy Policy.
7.4
You confirm that you have the necessary rights and permissions to submit your User Content.
You must not upload content that infringes another person's copyright, privacy, image rights, confidentiality or other legal rights.
7.5
You must not upload another person's photographs, voice recordings, likeness or personal information without appropriate permission.
7.6
We may reject, restrict, remove or stop displaying User Content where we reasonably consider that it:
Breaches these Terms;
Is unlawful;
Creates a safety risk;
Violates another person's rights;
Violates applicable app-store requirements; or
Is otherwise inappropriate for the Service.
We do not guarantee that every piece of prohibited content will be identified or removed immediately.
8. Messages, Voice Notes and Calls
8.1
Fate may enable users to communicate through messaging, voice notes, calls or other communication functionality.
8.2
Communications between users remain the responsibility of the participating users.
Fate does not endorse, verify or guarantee statements made by another user.
8.3
You must not record, reproduce, distribute or publicly share another user's private communication without the consent required by applicable law.
8.4
Fate does not currently record or store user-to-user voice calls for moderation or AI-training purposes.
Technical information or audio may nevertheless be processed temporarily by communications providers where necessary to transmit or provide the call or voice functionality, as explained in our Privacy Policy.
Certain communication or safety features may use automated processing where disclosed to you.
8.5
You must not use messaging, calls or voice functionality to:
Harass or threaten users;
Pressure or coerce users into sexual activity or meetings;
Send illegal or harmful content;
Conduct scams;
Request money as part of fraudulent or exploitative activity;
Evade blocks or safety controls; or
Continue contact after another user has clearly withdrawn consent to communicate.
8.6
Fate cannot guarantee that user communications will always be uninterrupted, delivered successfully, error-free or free from harmful or inappropriate material.
9. Safety, Reporting, Blocking and Moderation
9.1
Fate may provide tools intended to improve user safety, including:
Reporting;
Blocking;
Automated content detection;
Human moderation;
Fraud detection;
Account restrictions;
Profile or content removal; and
Other safety measures.
No safety system can eliminate all risk.
9.2 Reporting
If you believe that a profile, user, message, photograph, communication or other content:
Is illegal;
Is unsafe;
Violates these Terms;
Involves fraud or abuse;
Involves somebody under 18; or
Otherwise presents a safety concern,
you should report it using Fate's in-app reporting functionality or contact support@fatedating.com.
9.3 Blocking
Where available, you may block another user.
Blocking may prevent further interaction through Fate but cannot prevent somebody from contacting you through services outside Fate.
9.4 Moderation Action
Depending on the circumstances, Fate may:
Issue warnings;
Remove content;
Restrict profile visibility;
Restrict messaging, calls or other features;
Temporarily suspend accounts;
Permanently terminate accounts;
Reverse benefits or Tokens obtained through fraud or misuse;
Preserve information relevant to an investigation; or
Notify law enforcement or other authorities where appropriate.
9.5 Automated Moderation
We may use automated systems to identify potentially unsafe, prohibited or sexually explicit photographs and other content.
Automated systems may make mistakes.
Where an automated moderation decision materially affects your use of Fate, you may contact support@fatedating.com to request an explanation or human review where appropriate.
9.6 Complaints and Reviews
If Fate removes content, restricts functionality, suspends an account or terminates an account, you may contact support@fatedating.com to request review.
Certain information may be withheld where disclosure would:
Create a safety or security risk;
Interfere with an investigation;
Reveal another person's personal information;
Assist users in circumventing moderation systems; or
Be prohibited by law.
Nothing in these Terms limits any statutory reporting, complaint or appeal rights available to you.
10. Artificial Intelligence and Automated Systems
10.1
Fate uses artificial intelligence, machine learning, algorithms and other automated technologies to support features including:
Matching;
Recommendations;
Profile functionality;
Image processing;
Conversation assistance;
AI-generated insights;
Moderation;
Analytics; and
Other AI-supported functionality.
10.2
Automated systems may consider information including:
Profile information;
Photographs;
Voice-based information;
Preferences;
Age and gender filters;
Interactions;
Match history;
Usage;
Feedback; and
Information generated by automated analysis.
Further information is provided in our Privacy Policy.
10.3
AI-generated information may be inaccurate, incomplete, biased or inappropriate.
AI output does not constitute professional, medical, psychological, legal, financial or relationship advice.
10.4
You should exercise your own judgement when considering:
Matches;
Recommendations;
Compatibility information;
Dating insights;
Prompts;
Suggested messages; or
Responses generated by Fate's AI functionality.
10.5
Fate does not guarantee that an algorithmically recommended user:
Is compatible with you;
Is attracted to you;
Will respond;
Is truthful;
Is safe;
Is accurately represented; or
Will result in a successful interaction or relationship.
10.6
Matching and recommendation systems are not intended to make decisions that produce legal or similarly significant effects concerning you.
Automated systems may nevertheless affect which profiles, recommendations, content or features are shown to you.
10.7
If you have concerns about automated processing, contact support@fatedating.com.
Your data-protection rights relating to automated processing are explained in our Privacy Policy.
11. Subscriptions, Tokens and Payments
11.1 Purchases
Fate may offer subscriptions, Token packages, trials, promotional offers or other paid functionality.
The price, billing period, included features, Token allocation, trial period and other material purchase terms displayed immediately before you complete a purchase will form part of your agreement with Fate.
If there is an inconsistency between this section and the specific purchase information presented immediately before purchase, the specific purchase information will apply, subject always to your mandatory statutory rights.
11.2 Free Trials
Where Fate offers a free or discounted trial:
Eligibility may be limited;
The duration will be disclosed before you accept it;
The price payable after the trial will be disclosed before purchase;
The renewal frequency will be disclosed before purchase; and
Where the trial converts automatically into a paid subscription, this will be clearly stated before you subscribe.
Unless the purchase screen expressly states otherwise, you must cancel before the trial ends if you do not want the subscription to convert into a paid subscription.
11.3 Automatic Renewal
Subscriptions may automatically renew.
Before you purchase, the relevant purchase screen will tell you:
The price;
Billing frequency;
Trial arrangements, if any;
Whether the subscription renews automatically; and
How cancellation works.
Any renewal reminders or other subscription notices required by applicable law or app-store rules will be provided through the appropriate channel.
11.4 Payments
Purchases made through the App are generally processed by:
Apple App Store; or
Google Play Billing.
RevenueCat may be used to manage subscription status and entitlements.
Fate does not store your full payment-card details.
11.5 Cancelling a Subscription
Subscriptions purchased through Apple or Google should generally be cancelled through the app store through which they were purchased.
Apple: Manage your subscription through your Apple ID/App Store subscription settings.
Google Play: Manage your subscription through your Google Play subscription settings.
Deleting your Fate account or deleting the App does not automatically cancel an app-store subscription.
You should therefore cancel the subscription separately through Apple or Google.
Cancellation will generally prevent future renewal. Access to paid functionality may continue until the end of the period already paid for, unless the purchase terms, app-store rules or applicable law provide otherwise.
11.6 Tokens
Tokens are digital credits that may be used for eligible functionality within Fate.
Tokens:
Have no cash value outside Fate;
Cannot ordinarily be exchanged for cash;
Cannot be sold or transferred between users unless Fate specifically provides that functionality;
Are not cryptocurrency or stored monetary value;
Do not give you an ownership interest in Fate; and
May only be used for functionality made available through the Service.
The applicable Token balance, Token cost of an action, package terms and any applicable expiry, rollover or cancellation treatment will be displayed in the App or relevant purchase terms.
We may correct Token balances created by an obvious technical error or reverse Tokens obtained through fraud or misuse.
We may change Token costs for future transactions. Any change will not retrospectively remove a completed purchase or statutory right.
11.7 Promotions
Promotions may be subject to:
Eligibility criteria;
Territory restrictions;
Account limits;
Time limits;
Availability; and
Additional terms displayed with the promotion.
Promotional offers have no cash value unless expressly stated otherwise.
12. Refunds and Consumer Rights
12.1
Where a purchase was processed through Apple or Google, refund requests should normally be submitted through the relevant app-store refund process.
Fate may assist with support enquiries but does not control whether Apple or Google approves a refund.
12.2
Nothing in these Terms removes or reduces mandatory consumer rights.
Where applicable law gives you a right to:
Cancel;
Receive a refund;
Receive a price reduction;
Have a digital service brought into conformity; or
Obtain another statutory remedy,
those rights remain unaffected.
12.3
Except where applicable law, app-store rules or the specific purchase terms provide otherwise, you are not automatically entitled to a refund merely because:
You did not use the subscription;
You did not use available Tokens;
You did not receive a particular number of matches;
Another user did not respond;
You did not meet somebody; or
You did not achieve the dating or relationship outcome you hoped for.
12.4
Where Fate ends a paid service without cause attributable to you before the end of the paid period, we will provide any refund or other remedy required by applicable law.
13. Price Changes
We may change subscription or Token prices prospectively.
The price shown before purchase will apply to that transaction.
Where a change affects a renewing subscription, we will provide the notice required by applicable law and the relevant app-store rules.
Where legally required, you will be able to cancel before the new price takes effect.
14. Intellectual Property
Fate and its licensors own all intellectual-property rights in the Service other than User Content.
This includes rights relating to:
Software;
Interfaces;
Designs;
Branding;
Text and graphics;
Algorithms;
Databases;
Matching systems;
AI functionality;
Features; and
Trademarks.
Subject to these Terms, Fate grants you a limited, personal, revocable, non-exclusive and non-transferable right to use the Service for lawful personal purposes.
You must not, without permission:
Copy or commercially exploit the Service;
Modify, distribute, lease or sublicense it;
Remove intellectual-property notices;
Reproduce profiles or databases;
Build a competing service using Fate's protected materials;
Access Fate through unauthorised interfaces; or
Use Fate's protected systems or content contrary to these Terms.
If you voluntarily provide suggestions or feedback concerning Fate, we may use them to develop or improve the Service without an obligation to compensate you, subject to applicable privacy and intellectual-property law.
15. Third-Party Services
The Service relies on or integrates with third parties, including providers of:
Hosting;
Authentication;
App-store services;
Payments;
Subscriptions;
Communications;
AI;
Analytics;
Advertising and attribution;
Media processing; and
Push notifications.
Third-party services may have their own terms and privacy policies.
Relevant providers are described further in our Privacy Policy.
Availability or performance of third-party services may affect Fate.
We are not responsible for matters wholly outside our reasonable control, although this does not limit your statutory rights against Fate where applicable.
16. Service Availability and Changes
We aim to provide a reliable Service but cannot guarantee uninterrupted or error-free availability.
Fate may occasionally be unavailable because of:
Maintenance;
Updates;
Technical failures;
Internet or telecommunications failures;
Security incidents;
App-store restrictions;
Third-party outages; or
Events outside our reasonable control.
We may add, change, remove, suspend or discontinue features.
Where we materially change a paid service in a manner that gives you a legal right to cancel, receive a refund or obtain another remedy, those rights remain unaffected.
17. Suspension and Termination
17.1
You may stop using Fate at any time.
You may delete your account using the account settings.
Account deletion and data retention are explained in our Privacy Policy.
17.2
We may restrict, suspend or terminate accounts where we reasonably believe:
These Terms have been breached;
False or misleading information has been provided;
Fraud or abuse has occurred;
Another user may be at risk;
The account presents a safety, legal or security risk;
We are required to act by law, a regulator or an app store; or
A relevant Service is discontinued.
17.3
We may take urgent action without advance notice where reasonably necessary to:
Protect users;
Prevent immediate harm;
Investigate suspected illegal conduct;
Prevent fraud;
Protect the Service; or
Comply with legal obligations.
Where appropriate and legally permitted, affected users may request an explanation or review.
17.4
If your account has been permanently terminated for prohibited conduct, you must not create another Fate account without our permission.
17.5
Deleting your Fate account does not necessarily cancel an Apple or Google subscription.
Subscriptions must be cancelled separately through the applicable app store.
18. Dating and User Safety
Dating and meeting people involves inherent risks.
Fate cannot guarantee:
Another user's identity;
Their intentions;
Their relationship status;
Their honesty;
Their safety;
Their behaviour online or offline; or
The accuracy of information they provide.
You should exercise reasonable caution when communicating with or meeting other users.
In particular:
Do not send money to somebody you meet through Fate;
Do not provide passwords, verification codes or financial information;
Avoid giving out your home address before you are comfortable doing so;
Consider telling somebody you trust when meeting a user for the first time;
Meet initially in a public place;
Arrange your own transportation;
Leave if you feel uncomfortable or unsafe; and
Contact emergency services where there is an immediate threat to safety.
A profile appearing in Fate does not amount to an endorsement of that user.
19. Verification
Fate may offer profile, age, identity or other verification features now or in the future.
Where a profile displays a verification indicator, it means only that the account has successfully completed the particular verification process described for that feature.
Unless expressly stated otherwise, verification:
Is not a criminal background check;
Does not guarantee honesty or safety;
Does not guarantee that all information on a profile is accurate;
Does not remove the need to exercise normal caution; and
Does not amount to Fate endorsing the user.
20. Disclaimers
To the fullest extent permitted by law, Fate does not guarantee:
That every user is genuine or truthful;
That profiles are complete or accurate;
That every unsafe user or item of prohibited content will be identified;
That a match will be compatible;
That another user will communicate with or meet you;
That you will find a relationship;
That AI-generated information will be accurate;
That matching systems will identify every potentially suitable user;
That communications will always be uninterrupted;
That the Service will always be available; or
Any particular dating or relationship outcome.
You remain responsible for your own interactions and decisions.
Nothing in these Terms excludes any guarantee, representation, obligation or consumer right that cannot lawfully be excluded.
21. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:
Death or personal injury caused by negligence;
Fraud or fraudulent misrepresentation;
Mandatory consumer rights;
Data-protection liability that cannot lawfully be limited; or
Any other liability that applicable law does not permit us to exclude.
Subject to those protections and to the extent permitted by law, Fate is not responsible for losses arising solely from:
The acts or omissions of another user;
User Content;
Independent interactions between users;
An unsuccessful date or relationship;
Loss of an opportunity to meet somebody;
Events outside our reasonable control; or
Indirect losses that were not reasonably foreseeable when you agreed to these Terms.
Nothing in this section affects remedies to which you are entitled under mandatory consumer law.

Our Privacy Policy explains how Fate processes personal data, including information associated with:
Accounts;
Profiles;
Photographs;
Voice features;
Messages;
Calls;
Matching;
AI;
Payments;
Analytics;
Advertising;
Safety and moderation; and
Account deletion.
Our Cookie Policy explains the use of cookies and similar technologies on our website and relevant consent controls.
The Privacy Policy and Cookie Policy should be read alongside these Terms.

You may make a complaint about:
Another user;
User Content;
Illegal or harmful content;
Safety;
A moderation decision;
An account restriction;
Account suspension or termination;
Payments;
Subscriptions;

Another aspect of the Service.
You can use available in-app reporting tools or contact:
Please provide enough information for us to identify and investigate the issue.
We may request additional information where necessary to:
Understand the complaint;
Verify your identity;
Locate relevant information; or
Protect another person's privacy.
Where a complaint concerns illegal content, safety, moderation or account restrictions, we will handle it in accordance with applicable law and our relevant reporting and complaints procedures.
Nothing in these Terms prevents you from contacting a regulator, law-enforcement authority, consumer-protection body or court where you have the right to do so.
24. Governing Law
These Terms are governed by the laws of England and Wales.
If you are a consumer living in another part of the United Kingdom, you may also have rights under the mandatory laws applicable where you live and may be entitled to bring proceedings in your local courts.
If you live outside the United Kingdom, mandatory consumer protections and jurisdiction rules applicable in your country may also apply.
Nothing in these Terms requires a consumer to waive a mandatory legal right.
25. Changes to These Terms
We may update these Terms where reasonably necessary to reflect:
Changes to Fate;
New features;
Legal or regulatory requirements;
Security requirements;
Changes to our business operations; or
Changes to third-party services.
The latest version will be made available through Fate or our website and will display the date it was last updated.
Where required by law, we will provide additional notice of material changes.
If a change materially affects a paid Service, any applicable statutory cancellation, refund or other rights remain available.
26. General
26.1 Severability
If part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
26.2 No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.
26.3 Assignment
You may not transfer your rights or obligations under these Terms without our permission.
We may transfer our rights and obligations as part of a merger, acquisition, corporate restructuring or sale, provided your mandatory legal rights are not unfairly reduced.
26.4 Events Outside Our Control
We are not responsible for failure or delay caused by events outside our reasonable control, such as natural disasters, war, serious telecommunications outages, governmental action, cyberattacks, power failures or failures of third-party infrastructure.
This does not affect rights that cannot lawfully be excluded.
26.5 No Partnership
These Terms do not create an employment, agency, partnership, joint venture or fiduciary relationship between you and Fate.
26.6 Entire Agreement
These Terms, together with any specific purchase terms displayed before purchase and the applicable Privacy Policy and Cookie Policy, form the agreement governing your use of Fate.
26.7 Electronic Communications
We may communicate with you electronically through the App, push notifications, email or other contact information connected to your account, subject to applicable law.
26.8 Third-Party Rights
